PRICES
The prices shown cover existing stocks only and are not offered as quotations.
NWCS reserve the right to adjust selling prices without prior notice.
PAYMENT
1. Credit Accounts
To open a credit account references are required from two companies with whom you have credit facilities, your name, address and bank account number.
Payment will fall due on the last day of the month following date of invoice. Failure to pay by due date shall entitle NWCS to withhold despatch of future orders and may incur a 5% over base rate interest charge. Payment may be made by paypal or Cheque. Orders of great value may not be dispatched until payment is cleared.
2. Cash with order
Send cash or cheque remittance with your order to cover its approximate value plus charges for postage, packing, insurance and VAT. When the cheque has been cleared to our bank account, for which you must allow up to seven working days, an invoice will be issued with the goods.
RESERVATION OF TITLE TO GOODS All goods will remain the property of NWCS until payment is received in full by cash/card and any cheque given in payment has been honoured. If payment is not made NWCS without prejudice may recover and/or re-sell the goods. Therefore NWCS servants or agents may enter the buyer's premises to recover the goods. The buyer will be liable for all NWCS costs on such occasions. RETURN FOR CREDIT OR EXCHANGE Goods will not be accepted for credit or exchange unless the original date and invoice number are quoted and they are returned within seven days of receipt. We reserve the right to charge a minimum handling of £5.00, or 15% of the value of goods returned to us for reasons other than the goods are defective, or not in compliance with your order. PATTERNS Items sent to NWCS by way of pattern is entirely at the risk of the buyer and should make provision at their expense for any such item to be insured. DISPATCH CHARGES All goods are priced "Ex-Warehouse". We add appropriate amounts for postage, packing, insurance and VAT. If an order contains items which are temporarily out of stock or require obtaining specially, we will advise you of our intention to obtain at the earliest. As soon as the goods arrive, we will send these to you charging postage, packing, insurance and VAT as usual. If you do not wish to have items obtained, please state on your order "ONLY SUPPLY IF IN STOCK". CLAIMS, BREAKAGES & SHORTAGES Items with a value of £75 or over will be sent by recorded delivery - signed for or Special Delivery. In this case the proof of posting will be kept for 30 days from date of posting and we will provide you with a scanned copy of the certificate containing the serial number via email upon our being notified by you of loss or damage. In case of pilferage or damage, wrappings should be retained. All claims for lost or damaged goods must be made by you the purchaser and are between you and Royal Mail or other carrier, our responsibility ceases once the item enters the postal system. Shortages must also be reported to us within three days. GOODS ON APPROVAL We are prepared to forward certain goods on seven days approval to accredited customers only. If no goods are kept from an approval parcel, postage will be charged. PART DELIVERY It is our constant endeavour to carry adequate stocks of all items shown on the website. If certain items are not available on receipt of order, we will supply all that is in stock and the balance will follow as soon as possible. A list of 'to follow' items will appear on the delivery note and invoice. INVOICING Invoices are included with all deliveries unless otherwise requested. With larger concerns a delivery note accompanies the goods and an invoice is sent under separate cover. TRADE COUNTER Hours for our trade counter are daily Monday to Friday 9.30am - 4.00pm. TELEPHONE ORDERS When placing telephone orders please request: MATERIAL DEPARTMENT .
Official order numbers must be quoted by larger concerns. When sending confirmation of telephone orders please ensure that they are clearly marked CONFIRMATION.
We will accept email orders under the same terms as telephone orders. This service may also be used for price and delivery enquires.
REPAIRS AND RESTORATIONS
These are the Terms and Conditions governing the repair / restoration of your item by Northern Watch and Clock Supplies ("NWCS").
1. NWCS will repair or restore your item as described and for the charges shown on the reverse side (unless such charges are revised with your oral consent). When the item is covered by guarantee, NWCS will perform repairs under the terms of the guarantee provided that you have presented satisfactory proof of the item's eligibility for such repairs. You will be responsible for any additional charges applicable under your item's guarantee as described on the reverse side, including any applicable Value Added Tax.
2. Unless your item is repaired under guarantee without charge, you will pay NWCS the amount shown on the reverse side. Your payment is due when the item is returned to you. Unless specified otherwise, the estimated amount includes all parts, labour, and certain transportation required for the repair of the item plus any applicable Value Added Tax. NWCS may hold you responsible for a diagnostic fee of £25.00, plus any applicable Value Added Tax, if NWCS inspects your item, provides an estimate for you, and you do not authorise NWCS to undertake the repairs for the estimated charges. If NWCS determines, while inspecting your item, that repairs are needed due to failures of parts that are not supplied by NWCS or are needed due to damage caused by abuse, misuse or misapplication, NWCS reserves the right to return the item to you without repairing it, and will hold you responsible for the diagnostic fee of £25.00, plus any applicable Value Added Tax.
3. If the requested repairs require labour and/or parts not specified on the reverse side, NWCS may seek your approval of a revised estimate. If you do not agree that NWCS may revise the charges, NWCS may return your item and hold you responsible for the diagnostic fee shown on the reverse side, plus any applicable Value Added Tax.
4. If repairing your item under your item's guarantee, NWCS may use new, used or reconditioned parts, if permitted by the terms. If repairing parts outside of guarantee or extended service contract, NWCS may use new, used or reconditioned parts. NWCS will retain the replaced part that is exchanged under repair service as its property, and the replacement part will become your property. Replaced parts are generally repairable and are exchanged or repaired by NWCS for value. If applicable law requires NWCS to return a replaced part to you, you agree to pay NWCS the additional cost of the replacement item.
5. If NWCS repairs your item under guarantee, the repairs will be covered solely by the terms of the guarantee and applicable provisions of law. If your item is repaired outside of guarantee, NWCS warrants (1) that the repairs will be performed in a competent and professional manner and (2) that all parts used to repair your item will be free from defects in materials and workmanship for a period of one year for watches, two years for clocks and five years for Longcase Clocks unless otherwise specified by NWCS. Information on your item's parts guarantee may be obtained by contacting NWCS. The guarantee on parts is an express limited guarantee. If a defect exists in a replacement part during the part's guarantee period, at its option, NWCS will (1) repair the part, using new, used or reconditioned replacement parts, (2) replace the part with a new, used or reconditioned equivalent part, or (3) refund the fair market value of the part, as determined by NWCS. THIS GUARANTEE AND REMEDY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, WITH RESPECT TO THE REPAIR PARTS. NWCS SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO SUCH PARTS, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF NWCS CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED GUARANTEE, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS LIMITED GUARANTEE.
6. IF ANY ITEM SHOULD BE DAMAGED OR LOST WHILE IN NWCS'S CUSTODY, NWCS'S LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OF THE AFFECTED ITEM. SUBJECT TO THE PREVIOUS SENTENCE, NWCS'S ENTIRE LIABILITY FOR YOUR DAMAGES FROM ANY CAUSE WHATSOEVER WITH RESPECT TO THE REPAIR OF YOUR ITEM, WHETHER DUE TO NWCS'S NEGLIGENCE OR TO ANY OTHER REASON, IS LIMITED TO THE AMOUNTS THAT YOU PAY FOR REPAIR SERVICES. NWCS HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, SUCH AS LOST PROFITS OR REVENUE. NWCS ALSO HAS NO LIABILITY FOR INJURY OR DAMAGE TO FEELINGS CAUSED BY LOSS OR DAMAGE TO AN ITEM IN WHICH THE OWNER PLACES AN EMOTIONAL ATTACHMENT. YOUR ONLY REMEDY UNDER THIS REPAIR AGREEMENT IS TO SEEK RECOVERY OF DAMAGES AGAINST NWCS IN AN AMOUNT NOT TO EXCEED WHAT YOU HAVE PAID FOR REPAIR SERVICES.
7. If you have not claimed your item and paid all charges due within thirty (30) days after being notified by NWCS that your item has been repaired, NWCS will consider your item abandoned. NWCS will provide such notice to you at the mailing address you furnished when you authorized the repairs. NWCS may dispose of your item in accordance with applicable provisions of law, and, specifically, may sell your item at a private or public sale without liability to you. NWCS reserves its statutory and any other lawful liens for unpaid charges.
8. These Terms and Conditions are governed by the laws of the United Kingdom (without giving effect to its conflict of law provisions). If any provision of these Terms and Conditions is held to be illegal or unenforceable, that provision will no longer be part of the Terms and Conditions, and the Terms and Conditions will be enforceable as though that provision never was a part of them.
9. These Terms and Conditions are the only ones that govern NWCS's repair of your item. No other oral or written terms or conditions apply, including ones in any purchase order that you provide to NWCS. No one has the authority from NWCS to vary any of these Terms and Conditions.
10. NWCS items are subject to United Kingdom and foreign export control laws and regulations, and must be purchased, sold, exported, re-exported, transferred, or used in compliance with such export laws and regulations.
11. You agree and understand that it is necessary for NWCS to collect, process and use your data in order to perform the service and support obligations under these Terms and Conditions. NWCS will protect your information in accordance with the Data Protection Act 1998. GENERAL INFORMATION
Although every effort has been made to ensure the accuracy of all the information displayed on the web site, Northern Watch & Clock Supplies can not accept any responsibility for any errors or omissions and reserves the right to vary, amend or cancel any of the arrangements featured on the web site should they find such alterations necessary.
ITEMS NOT ON WEBSITE
Lack of space prevents us listing all the items we hold in stock. If your requirements are not listed on the website, please enquire for availability, price and delivery.
DATA PROTECTION
Any information supplied to Northern Watch & Clock Supplies is held in accordance with the data Protection Act 1998 and may be used by Northern Watch & Clock Supplies to keep you informed of special offers and products which we believe are of interest to you. We do not disclose personal information to any other organisation.
